CDA seeks time from IHC to submit detailed report

ISLAMABAD: Capital Development Authority (CCDA) on Thursday sought some time from Islamabad High Court to submit a detailed report on the dumping of garbage in G-10 and H-10 sectors.

Chief Justice Sardar Mohammad Aslam adjourned hearing into the petition till Jan 9 at the request of the CDA’s legal advisor. Riaz Hanif Rahi advocate, President City Welfare Council, told the court that the civic body was continuously dumping garbage in the two sectors bordering Kashmir Highway.

He said the practice was not only causing environmental hazards, but also the passers-by and motorists had to endure the stench emanating from the rotting garbage.

The court had taken suo motu notice of the problem on July 2 last year. The CDA had filed a compliance report on August 8 on removal of garbage, but despite that it continued to dump garbage in the open.

The petitioner said that the authority should be penalized under Pak-PEPA Act 1997 and cited Shehla Zia’s case (PLD 1994 of Supreme Court) in support of his arguments. Rahi prayed to the court to constitute a court commission or appoint an environment magistrate to ensure removal of the garbage.

Cook handover case: Meanwhile, in another case the chief justice suspended a decision of Special Judge Central, Rawalpindi, for handover of an official cook of Pakistan Army for his tribal by a military court.

The handover was ordered on a petition moved by Aamir Altaf, who claimed that Mazhar Hussain borrowed Rs 1.2 million from him on the promise of sending him to Spain. He said when he demanded his money, the cook gave him dud cheques.

While the case was pending with the Special Judge Central Rawalpindi, the commandant officer of Pakistan Army, Rawalpindi, wrote a letter to the judge seeking custody of the accused to try him in a military court.

After hearing arguments of the counsel, the chief justice observed that being a cook the accused could not be called a military man. He issued notices to the respondents and adjourned hearing till a date in office. app
