Karachi: SHC naazir told to inspect entire land of Gutter Baghicha
KARACHI: Directing nazir of the Sindh High Court (SHC) to inspect the entire land of Trans Lyari Park or Gutter Baghicha, Old Golimar, for alleged continuation of construction activity in violation of a stay order by SHC, Justice Maqbool Baqar asked the police, town nazim SITE and other respondents to ensure enforcement of ban on construction activity placed by the court.
The bench was hearing a contempt plea moved by Barrister Naeem-ur-Rahman on behalf of his clients including social welfare organisations of the area, concerned citizens etc fighting a war to save 850 acres of the prime located as Trans Lyari Park. A stay order by the Supreme Court regarding KMC Officers Cooperative Housing Society sprawling over 200 acres (out of total 1,100 acres) with 500 to 700 square yard plots is already in existence. The applicant maintained that nazir of SHC inspected the place on orders of the bench on Wednesday but Manzoor Ahmed EDO Law of the City District Government Karachi (CDGK) mislead the nazir stating that inspection was ordered by SHC only to the extent of KMC Officers Housing Society while major construction activity was being carried out on another portion of the land allotted to activists or supporters of a coalition partner in Sindh government illegally. The petitioner sought a re-inspection as per orders of the SHC bench. The bench after hearing the sides ordered nazir to again inspect the place and make a report. The bench adjourned further proceedings while directing the office to fix the same for hearing after Eidul Fitr vacations. FIR against ACLC SHO, co-accused ordered: District and Sessions Judge South Faheem Ahmed Siddiqui on Thursday ordered registration of FIR against Anti-Car Lifting Cell SHO Ishaq Lashari and his alleged henchman Ismail Lashari for keeping a man Soharo in illegal custody at a private safe house. Ghulam Shabbir, brother of the detainee moved the court filing a habeas corpus petition and seeking recovery and release of his brother from illegal detention. The head bailiff of the court on orders by the DJ raided a place on Wednesday pointed out by the applicant and the detained was recovered. The court perused the report by the bailiff and also recorded the statement of the detainee who narrated his ordeal and nominated Ishaq Lashari and Ismail Lashari as his captors. The court ordered lodging of a formal FIR against the nominated accused under the relevant sections of the law. staff report http://www.dailytimes.com.pk/default.asp...009_pg12_2 |
